Trees are generally protected under Local Council Tree Preservation Orders. Some trees are protected by the Threatened Species Conservation Act 1995, the Native Vegetation Act 2003 and the Threatened Species Conservation Biodiversity Regulation 2008.
Your Arborist or Local Council should be able to identify if your tree is protected by legislation.

One of the problems with the tree industry is the lack of regulation. There is no license required to operate in the tree industry.

The code of practice and the Australian standards are industry guidelines and unlike an act you cannot be prosecuted if you do not comply.

Reputable Arborists, not those branded tree loppers, should abide by, and follow the Act, Code of practice and the Australian standards.

All service providers are legally obliged to comply by the Work Place Health and Safety Act 2011
